Terms of Service

These Terms of Service ("Terms") govern your use of gabeworks.co (the "Site") and any services provided by GabeWorks ("we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms.
Services
GabeWorks provides automation and website services for local businesses. Specific deliverables, timelines, and fees are agreed in writing on a per-engagement basis. Pricing displayed on the Site is informational and may change.
Fees & Payment
- Activation fees are due before work begins. Website setup/build fees may apply when a website is included.
- Monthly servicing is billed in advance, month-to-month.
- Plans may be cancelled at any time; service continues through the end of the paid month. Monthly fees are not pro-rated or refunded for partial months.
- Late or failed payments may result in pause or termination of services.
Refunds & Guarantee
Activation fees are refundable until onboarding begins. Once the build starts, activation becomes non-refundable. If launch is delayed because of something on our side, the activation fee is credited back over future invoices. Monthly servicing can be cancelled at any time; service continues through the end of the paid month and monthly fees are not pro-rated. Annual plans are charged upfront before the build begins and are not pro-rated or refunded for partial terms. Full details on our Refund Policy page.
Ownership & Cancellation
Your customer data, accounts, domain, and website content remain yours. Automations run on infrastructure managed by GabeWorks; monthly servicing covers hosting, monitoring, fixes, and associated third-party account costs (e.g. Twilio). The automation configurations, workflows, and underlying tooling we develop or license remain the property of GabeWorks unless explicitly transferred in writing. When monthly servicing ends, the automations are deactivated, but you retain full ownership of your accounts and data and may rebuild on your own infrastructure at any time.
Client Responsibilities
You agree to provide accurate information, timely access to required accounts (CRM, phone system, domain, etc.), and to comply with applicable laws — including telecommunications regulations such as the TCPA and CAN-SPAM where relevant — when sending messages to your customers through the automations we build.
Acceptable Use
You agree not to use our services for unsolicited messaging, illegal activity, harassment, or any purpose that violates the policies of the underlying platforms (Twilio, email providers, hosting, etc.). We may suspend services for violations.
SMS Messaging Terms
If you opt in to SMS on our contact form, GabeWorks may send text messages about your inquiry, quotes, scheduling, reminders, and follow-ups. Message frequency varies, typically 1–5 messages per inquiry. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. Consent to receive SMS is not a condition of purchase. Mobile opt-in data and consent are not sold or shared with third parties or affiliates for marketing or promotional purposes.
Disclaimers
The Site and services are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific results, revenue, or lead volumes. Third-party platforms used in delivery may experience downtime outside our control.
Limitation of Liability
To the maximum extent permitted by law, GabeWorks' total liability for any claim arising from the Site or services is limited to the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Termination
Either party may terminate ongoing services at any time. We may terminate immediately for breach of these Terms, non-payment, or misuse.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York.
Changes
We may update these Terms from time to time. Continued use of the Site or services after changes are posted constitutes acceptance.
