Terms of Service

These Terms of Service ("Terms") govern your use of gabeworks.co (the "Site") and any services provided by GabeWorks ("we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms.

Services

GabeWorks provides quote recovery portal, setup, and related contractor follow-up services. Specific deliverables, timelines, and fees are agreed in writing on a per-engagement basis. Pricing displayed on the Site is informational and may change at any time.

Fees & Payment

• Setup fees are due before setup work begins.
• Monthly portal access is billed in advance, month-to-month.
• Monthly service can be cancelled at any time; service continues through the end of the paid period. Monthly fees are not pro-rated or refunded for partial periods.
• Late or failed payments may result in pause or termination of services.

Refunds

Setup fees are refundable until setup or onboarding begins. Once we start importing estimates, configuring your portal, or performing setup work, the setup fee is non-refundable. Monthly service can be cancelled at any time; service continues through the end of the paid period and monthly fees are not pro-rated. Full details on our Refund Policy page.

Ownership & Cancellation

Your customer data, quote and estimate records, and account information remain yours. The portal software, configurations, templates, and underlying tooling we develop or license remain the property of GabeWorks unless explicitly transferred in writing. When monthly service ends, portal access is deactivated, but you retain full ownership of your data and may request an export.

Client Responsibilities

You agree to provide accurate information, timely access to the estimate and quote data needed for setup, and to comply with applicable laws — including telecommunications and email regulations such as the TCPA and CAN-SPAM where relevant — when you contact your own customers using messages suggested by the portal.

Acceptable Use

You agree not to use our services for unsolicited messaging, illegal activity, harassment, or any purpose that violates applicable law or the policies of the underlying platforms we rely on. We may suspend services for violations.

SMS Messaging Terms

If you opt in to SMS on our contact form, GabeWorks may send text messages about your inquiry, quotes, scheduling, reminders, and follow-ups. Message frequency varies, typically 1–5 messages per inquiry. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. Consent to receive SMS is not a condition of purchase. Mobile opt-in data and consent are not sold or shared with third parties or affiliates for marketing or promotional purposes.

Disclaimers

The Site and services are provided "as is" without warranties of any kind, express or implied. We make no guarantee of recovered revenue, booked jobs, close rate, or margin improvement, and no guarantee of any specific results, revenue, or lead volume. Third-party platforms used in delivery may experience downtime outside our control.

Limitation of Liability

To the maximum extent permitted by law, GabeWorks' total liability for any claim arising from the Site or services is limited to the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Termination

Either party may terminate ongoing services at any time. We may terminate immediately for breach of these Terms, non-payment, or misuse.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York.

Changes

We may update these Terms from time to time. Continued use of the Site or services after changes are posted constitutes acceptance.
